DIRECTOR OF LITIGATION

Ms. Bessler has over 20 years of experience in a variety of matters including construction issues, breach of contract, negligence, breach of fiduciary duty, property disputes, easements, unfair business practices, fraud and intentional torts. Ms. Bessler also provides strategic counsel to clients on construction related transactional matters, including the preparation and negotiation of construction contracts with the goal of avoiding litigation. She has successfully mediated and arbitrated more than 100 disputes.

Representative Litigation Engagements:

 

  • Representation of commercial high-rise property owner regarding dispute with contractors and manufacturer for alleged painting defects.  Obtained seven figured settlement for client.

  • Representation of 1000+ lot community association regarding dispute with neighboring golf course.  After four week trial, obtained directed defense verdict on all golf course owner’s claims, including lost profits; and prevailed on all of client’s counter-claims, with award of attorneys’ fees. 

  • Representation of homeowners association in dispute with contractors concerning alleged defective waterproofing.  Obtained seven figure settlement for client.

  • Representation of property owner in Barbershop tract of La Jolla in dispute with neighboring owner over maintenance, repairs and cost-sharing agreement.  Obtained binding arbitration award in favor of client, with recovery of attorneys’ fees. 

  • Representation of general contractor in a $3 million dollar Miller Act Claim action.

  • Appeal and negotiation of Cal/OSHA serious citation on behalf of earthwork contractor. Successfully obtained reclassification of citation.

  • Representation of community association in dispute with homeowners over alleged unapproved improvements and construction.  Obtained binding arbitration award in favor of clients including award of attorneys’ fees.

  • Representation of developer of mixed use urban project in dispute with general contractor over improper construction, delay and change orders.  Obtained successful settlement through mediation.

  • Representation of developer of multi-unit residential project in dispute with general contractor concerning delays and unapproved change orders.  Obtained successful settlement.

  • Representation of owner of multi-million dollar residential property regarding dispute arising from pre-purchase inspections.  Obtained successful ruling on one week bench trial.

  • Representation of converted condominium association against developer for defects.  Obtained favorable settlement pre-filing of a complaint.

  • Representation of individual against partner in dispute over real estate deal gone bad.  Obtained favorable settlement for client.

  • Representation of business owner against former employee for fraud, breach of contract, interference with contract.  Obtained favorable settlement for client.

 

Representative Transactional Engagements:

 

  • Negotiation and drafting of construction contracts.

  • Preparation and drafting of real estate documents, including but not limited to amendments to CC&Rs, license and indemnity agreements and easements.

  • Negotiation and drafting of commercial leases on behalf of lessees and lessors

 

Admitted to practice before all California State and Federal Courts, Ms. Bessler continues to study new laws and techniques to benefit her clients. She received her Juris Doctor from Loyola Law School, where she was a member of the St. Thomas More Law Honor Society. As an undergraduate, she was on the Dean’s List and interned for the Honorable Bert Glennon, Jr. Judge.

 

When not assisting clients, Ms. Bessler enjoys the beach, yoga, live music, playing Uno with her son, volunteer editing for interesting publications, and spending time with her family, friends and two dogs.
